Who Can Legally Do Surrogacy in Ukraine?

Surrogacy in Ukraine is a highly regulated at a federal level. This protects intended parents, surrogates, donors, and children conceived through surrogacy. Clinics are inspected and intended parents, surrogates and donors must meet certain criteria.
Ukraine’s surrogacy program has always been open to international intended parents however, by law, there are restrictions as to who can participate.

  • Couples must be legally married traditional marriages of opposite sexes. Individuals and same sex couples, even those legally married, are not able to participate.
  • The intended mother must have a medical reason why she cannot carry a child to term. It could be because of a condition from birth, the result of a disease or previous birth that has led to secondary infertility or it could be because her health or the healthy of the child would be at danger if she carried the child.
  • Your doctor will be asked to formally confirm the medical diagnosis and provide documentation.
  • If you have undergone 4 rounds of IVF unsuccessfully you are also eligible to participate.
